Ensure compliance or Commissioner Secy to appear in person: CAT

JAMMU, Sept 9: The Central Administrative Tribunal (CAT), Srinagar Bench, has issued strict directions in a contempt case linked to non-payment of salary, warning that the incumbent Commissioner Secretary may have to appear personally before the court if compliance is not ensured.
The order came after the Tribunal recalled its earlier decision of February 15, 2024, when the contempt petition was dismissed for non-prosecution. The move followed a judgment by the J&K and Ladakh High Court on July 16, 2025, which dismissed a writ petition filed by the respondents and upheld the Tribunal’s orders directing salary release.
The Tribunal stressed that it is under “command from the High Court” to ensure its orders regarding salary release are implemented “in letter and spirit.”
“In the meantime, the DAG for the respondents is directed to comply with the directions of this court as well as the Division Bench of the High Court, failing which the present incumbent Commissioner Secretary shall cause his presence before the court in person,” the order reads.
The case, Sameena Safder Versus Dr Piyush Singla, will be heard next on October 14, 2025, along with the main transfer application.
