JAMMU, Jan 22: In the much publicized Ch Nagar Singh CD case, Special Municipal Magistrate Jammu, V S Bhou has submitted the enquiry report to the Chief Judicial Magistrate for perusal and further necessary orders.
The enquiry into the CD row was ordered after Ch Nagar Singh, who is facing trial in the Amandeep Singh murder case and presently lodged in Sub-District Jail Hiranagar, filed a complaint under Sections 500 and 503 RPC and 66-A Information Technology Act mentioning that police officers namely Basant Rath, the then SSP Jammu, Mubassir Latifi, the then SP, Abdul Rouf Lone, Kamaljeet Singh and Hardeep Singh Gill subjected him (complainant) to unprecedented torture, both physical and mental while he was in custody of the police at Gandhi Nagar Police Station.
In the report, Special Municipal Magistrate has pointed out that CFSL Chandigarh Vide report dated November 20, 2012 has confirmed that voice and image in the Compact Disc belong to Nagar Singh.
“The allegations are confirmed as true and truthfulness of the complaint as such is also confirmed. Moreover, the voice and image of the complainant has been found matching with the voice and image shown in the alleged compact disc. In the face of the fact, the Compact Disc has been found to be authentic, un-doctored and the contents of the same are self speaking with respect to the version of the complainant about the treatment meted out to him”, the report said.
“Apart from unprofessional attitude of Special Investigation Team (SIT) members to interrogate complainant, they have acted arbitrarily and failed to comply with prescribed procedure of law. The snide, indecent, obscene and vulgar remarks of Basant Rath, the then SSP Jammu against woman folk in general and daughter-in-law of the complainant in particular expose mind set of such a senior police officer against the women”, the report said, adding “the unsuccessful attempts of Basant Rath and others to implicate ministers, politicians and civil, police officers and media persons again appear to be beyond the purview of entrusted investigation and thus violative of code of conduct for police and cherished principles of law and fair investigation”.
