JAMMU, May 8: District Magistrate, Jammu, Ajeet Kumar Sahu today cautioned the management of Government as well as private schools against resorting to corporal punishment and said that any institution found committing violation of the provisions will be prosecuted under the Juvenile Justice Act and other relevant provisions of law.
In the order, the District Magistrate said, “complaints have been received that children are not treated properly and undue mental harassment is caused to them in case of any dispute with parent”, adding “it has further been complained that if any parent protest against the corporal punishment or any similar mental harassment, the school management expel the child on unreasonable grounds”.
“The management of schools must ensure that no child is expelled from the schools without any sufficient reason and in case under any unavoidable situation a child need to be expelled the management must report the matter to the Juvenile Welfare Board before taking any action in this regard”, DM said.
The District Magistrate further said that in case any institution found committing violation of the provisions will be prosecuted under the Juvenile Justice Act and other relevant provisions of law.
While cautioning the schools in this regard, the District Magistrate has also drawn their attention towards the Circular of School Education Department dated February 16, 2009 whereby all the Government as well as private schools were directed to ensure that students are not given any corporal punishment as that might only promote further undesirable behavior among them rather than helping them imbibe alternate desirable behavior.
Even the Supreme Court of India banned corporal punishment in schools way back in 2000 and in compliance of the orders of the court the NCPCR issued guidelines for eliminating corporal punishment in schools as such a punishment carries the potential of impairing the trust bonds between the teachers and students besides being apt to cause delinquency and mental health problems among the abused children.
The corporal punishment is also generally perceived to be responsible for children getting shy, feeling insecure, becoming resentful or even violent.
