Delhi HC rejects parole plea of POTA convict

NEW DELHI, Sept 25: The Delhi High Court has dismissed a parole petition filed by a LeT terrorist Mohd Ayoub Mir convicted under POTA and serving a life sentence.
Opposing his plea, Rushab Aggarwal, Standing Counsel for UT of Jammu & Kashmir and Sanjeev Bhandari, Counsel for NCT of Delhi argued that Mir’s case did not merit indulgence on medical or humanitarian grounds. They stressed that parole is an extraordinary concession, not a right, and highlighted his previous misuse of liberty.
Authorities cited reports that during his earlier parole (2015–2018), Mir instigated youth in Srinagar to join militant ranks, leading to cancellation of his release. They also referred to a 2018 prison incident where he allegedly incited fellow inmates to raise anti-national slogans, resulting in his transfer to Kot Bhalwal Jail, Jammu.
The respondents maintained that Mir is receiving adequate treatment at Government Medical College, Jammu, and even declined an earlier court-suggested transfer to a Delhi cancer hospital. They warned that his release, especially in Srinagar, posed genuine security risks.
Justice Sanjeev Narula, while acknowledging Mir’s prolonged incarceration and cancer diagnosis, held that the “balance presently tilts against the grant of parole.” The Court noted credible apprehensions based on past conduct and intelligence inputs, and accordingly declined relief. However, it directed that the petitioner continue to receive the best possible treatment in Jammu and be shifted to a higher facility if necessary.
