Srinagar, July 17: The High Court has upheld the personal appearance of Secretary Revenue before the Central Administrative Tribunal (CAT) and impressed upon the Tribunal to proceed ahead in order to ensure its orders are complied with.

The Division Bench of Justice Sanjeev Kumar and Justice Sanjay Parihar has dismissed the plea of Government challenging the order of CAT bench Srinagar whereby Secretary Revenue Department was directed to remain present before the CAT for not releasing the salary of the aggrieved employee working as junior assistant in the office of Deputy Commissioner Ganderbal.
Brief facts of the case are that the said employee was appointed in the year 2007 and was continuously working there and her salary was stopped in the year 2012 on the ground of illegal appointment. The CAT bench directed the authorities to release her salary as also directed the personal appearance of Secretary Revenue for not complying with the orders.
These orders have been challenged by the Government in the instant case and the court after perusal of the record opined that the CAT orders do not call for interference as the same are perfectly legal. The court recorded that the interim order in favour of the applicant-employee has been passed way back in the year 2015 and is yet to be complied.
“In these circumstances, the Tribunal was left with no option but to direct the personal appearance of the Revenue Secretary to explain as to why the orders have not been complied with so far and as to why the salary of the employee has not been released.
The DB emphasized on the CAT bench to proceed ahead in the matter to ensure that the orders passed regarding the salary are complied with by the authorities in letter and spirit.
