DB upholds acquittal of Major in alleged wife murder case

JAMMU, Feb 10: A Division Bench of Jammu & Kashmir and Ladakh High Court comprising Justice Rajnesh Oswal and Justice Rajesh Sekhri has upheld the acquittal by the Trial Court of Major Viveki Rai, who was allegedly involved in murder of his wife.
After hearing both the sides, the DB observed, “there are un-explained gaps in the prosecution case and the chain of circumstances is not complete in such a manner, that only one conclusion in respect of the guilt of the accused-respondent can be drawn and the ineluctable conclusion is that the prosecution has not been able to prove its case beyond reasonable doubt and the opinion formed by the trial court cannot be held as perverse or impossible, warranting any interference by this court”.
Accordingly, this appeal was dismissed for being devoid of any merit.
