Implementation of Shetty Pay Commission recommendations

JAMMU, Feb 13: Division Bench of State High Court comprising Chief Justice Gita Mittal and Justice Tashi Rabstan today expressed displeasure over non-compliance of the orders regarding implementation of Shetty Pay Commission recommendations.
In a petition filed by the employees borne on the cadre of Subordinate Courts through Judicial Employees Welfare Association State President Mangat Ram Parihar and others seeking implementation of Shetty Commission recommendations, the DB by order dated 9th of March, 2016 had directed the respondents to implement the recommendations of the Shetty Commission.
As this order was not complied with, the petitioners, who are staff of the District Courts, were constrained to file a contempt petition against the then Chief Secretary and other officers. During the pendency of the Contempt Petition, counsel for the respondents filed the status report mentioning that Finance Department has conveyed its concurrence to the decision taken in the meeting held on 01.08.2017.
It was further submitted that the proposals on the recommendations were decided to be re-examined and the decision will be taken immediately thereafter. It was submitted by the Senior Additional Advocate General that the recommendations shall be implemented in its letter and spirit and the respondents shall accord the benefit of the recommendations of the Shetty Pay Commission to the ministerial staff of the Subordinate Courts in the State by granting one advance increment at the existing pay scale and the respondents shall also create 53 posts of Section Officers.
In view of the submissions of the Senior Additional Advocate General, the DB had preferred not to proceed further with contempt proceeding with liberty to the petitioners that in case the recommendations are not implemented within a period of two months they shall file fresh contempt petition, if so advised.
“It appears that the directions of the Division Bench as well as the recommendations of the Shetty Commission have not been complied with in entirety, as a result second contempt petition came to be filed and on 19th February, 2018, last opportunity was granted to the respondents to file statement of facts. Even this order has not been complied”, the DB said, “we defer the orders and direct that a copy of the order be placed before Chief Secretary”.
