DB directs State to comply with directions

JAMMU, Apr 22: In a Public Interest Litigation (PIL) filed by Bar Association Jammu and Sumit Nayyar seeking various development activities around court complex including parking, new road, health center and security of the Advocates, Judges and Litigants, Division Bench of High Court comprising Chief Justice MM Kumar and Justice Muzaffar Hussain Attar today took serious note of non-compliance of earlier order whereby Chief Secretary was directed to enforce the decisions taken by the committee headed by Registrar General of the High Court and in consultation with the President Bar Association Jammu.
When the matter was taken-up, Division Bench observed, “sanction has been accorded to release a sum of Rs 54 lakh in favour of Chief Engineer, PWD(R&B), Jammu for placing the same at disposal of the Managing Director, J&K PCC for construction of Lawyers’ Chambers. The release order has been passed in pursuance of Government Order No.34-PD of 2014 dated 16.04.2014 stipulating that 25% of the current year’s plan revenue component under State and District Sector as detailed in “Demand for Grants 2014-15″ on the plan budget is to be released”.
“We fail to understand as to how the release of Rs 54 lakh would help in overcoming already created dues of J&KPCC which exceeds Rs 2 crore”, the DB said, adding “on account of absence of counsel for the petitioner, we do not observe anything more than this at this stage”.
Accordingly, the DB directed that matter be listed on June 12, 2014. Meanwhile order dated 06.03.2014 shall be complied with.
