DB directs Home Secy, J&K Spl Tribunal to file status of enquiries

JAMMU, Mar 14: Division Bench of the State High Court comprising Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan today granted three weeks time to the Commissioner Secretary Home Department and Registrar J&K Special Tribunal to file the updated status of the pending departmental enquiries.
After hearing Advocate Sheikh Shakeel Ahmed with Advocate Rahul Raina appearing for the petitioners, Advocate General D C Raina with Senior AAG Seema Shekhar Khajooria appearing for GAD and AAG W S Nargal appearing for Home Department, the Division Bench also directed the petitioners to file their respective statement to the status reports filed so far by the several Administrative Departments of the State.
When this much publicized PIL came up for hearing, Advocate S S Ahmed appearing for the petitioners drew the attention of the court to the directions passed on the last date of hearing— February 29, 2016 when 8 Administrative Secretaries had been impleaded as party respondents and were directed to file the status of the pending departmental enquir-ies.
He further submitted that 15 Administrative Secretaries have so far filed the updated status of the pending departmental enquiries. “In almost all the status reports the position is same— the enquiry reports have been submitted and the same are under examination by the competent authorities”, he said, adding “the matters are being delayed without any lawful justification and in some cases even the delinquent public servants have attained superannuation”.
