JAMMU, Nov 1: In a Public Interest Litigation (PIL) filed by Welfare Association of Share Holders of Sheen Finance and Investment (India), Sheen Agro Plantation Ltd and Sheen Road Links Limited, Division Bench of State High Court comprising Justice Ali Mohammad Magrey and Justice BS Walia has directed the respondents to submit report before the next date.
When the matter was taken-up, Advocate BS Bali submitted that Deputy Commissioner, Ramban has not complied with the direction. On the submissions of AAG Ehsan Mirza, DB granted two weeks time and also observed that B L Saraf, Principal District & Sessions Judge (retired) appointed as Court Liquidator submits that he could not file the status report as the SEBI despite request has not submitted the details.
Upon this, Division Bench directed Registrar Judicial to convey the order of this court passed on 07.10.2015 read with order passed today to the authorities of SEBI for implementation of the directions.
Division Bench further observed, “B L Saraf submits that he is not in a position to continue as Liquidator on the health grounds, therefore, seeks direction to be relieved”. Accordingly, DB directed Registrar Judicial to submit a panel of retired Principal District & Sessions Judges on the next date of hearing for appointing one of them as Court Liquidator in place of B L Saraf.
