Srinagar, Mar 14: Division Bench of High Court today admitted the appeal filed by President Teachers Forum Abdul Qayoom Wani challenging the judgment of writ court whereby his repatriation was held to be legal and valid.
The Division Bench of Justice B L Bhat and Justice B S Walia admitted the appeal of Wani and appearing counsel for the State extended his assurance that the position with regard to appellant, Wani existing as on date will be maintained till the matter is finally disposed of by the court.
The writ court on March 4 while dismissing the writ petition of Wani had held that the transfer and posting is an exigency of service and the order of transfer of the petitioner does not show any kind of mala fides on part of the respondent-Government.
Underscoring to form any ‘Union or Association’, writ court had said that it is a constitutional right but with certain limitations and on this assumption an employee cannot seek posting of his choice or to refuse to obey a transfer and posting order.
