Court’s directive to SSP Jammu to preserve land in Karan Nagar

JAMMU, Aug 2: The court of 1st Additional District Judge Jammu has reiterated earlier orders to preserve and protect a suit property measuring 8 kanals situated in Karan Nagar, opposite Jambulochan with the direction to the Senior Superintendent of Police (SSP) Jammu to visit the spot, remove alleged encroachers and file a compliance report before August 20.
The matter pertains to a civil suit titled Tirath Amla Versus Satish Kumar & Others, which has been pending adjudication since before 1993. The High Court had, through an order dated August 4, 1993, ordered attachment of the property, making it absolute till final disposal of the suit. The land, as such, is under the custody and supervision of the court.
Earlier, on May 8, 2017, the trial court had directed the SSP Jammu to ensure that the property be preserved and not interfered with in any manner. A compliance report filed at that time confirmed fencing of the land and installation of a signboard indicating that the property was under court attachment.
However, on July 29, 2025, the applicant-defendant Tirath Amla submitted a fresh application under Section 151 of the Civil Procedure Code (CPC), alleging that certain miscreants, namely Pranav Sharma, at the behest of Shravan Dutt, had trespassed onto the suit property, removed the barbed wire fencing, and took down the official signboard.
Taking serious note of these developments, the court stated that the suit land remains under custody of the court and reaffirmed that it must remain protected from any third-party interference. The court has directed SSP Jammu to visit the site to verify any violation of the court’s earlier orders, particularly the one dated May 8, 2017.
“If any breach is detected, the SSP must implement the court’s order in letter and spirit by restoring the status quo. Further, the SSP has been mandated to protect the court property from trespassers, prevent alteration of its character, and remove any encroachers attempting to interfere with or change the nature of the land”, read the order.
