SRINAGAR, Mar 31: The Anti-Corruption court today convicted five employees in a fake appointment of a teacher in the education department and sentenced them for five-year imprisonment besides imposing a fine on them.
The Special Judge, Anti-Corruption Pulwama sentenced Ghulam Mohammad Sheikh and Bashir Ahmad Shah, both residents of Dadsar Tral and Syed Showkeen Andrabi of Chandgam Nownagri, Pulwama, for offence under J&K Prevention of Corruption Act to simple imprisonment for five years and a fine of Rs 50,000.
“For offences under section 468 RPC and 120-B RPC, the convicts are sentenced to simple imprisonment for five (05) years and a fine of Rs.30,000. In default of fine, further simple imprisonment for three (03) months. For offences under Section 420 RPC, the convicts are sentenced to simple imprisonment for three (03) years and a fine of R.20,000. In default of fine, further simple imprisonment for three (03) months”, read the judgement.
The court sentenced the convicts Mohammad Ashraf Khan of Naina, Batpora and Hamida Akhter of Bijbehara for offence under section 120-B RPC of J&K P.C Act and 468 RPC to simple imprisonment for five (05) years and a fine of R.50,000.
“For offence under section 420 RPC, the said convicts are sentenced to simple imprisonment for three (03) years and a fine of R.20,000. In default of fine, further simple imprisonment for three (03) months”, reads the judgment.
The court, however, said all the substantive sentences of imprisonment shall run concurrently and the effective term of imprisonment shall be five years for each accused. “The period of detention, if any, already undergone by the convicts during investigation or trial in connection with this case shall be set off”, the court clarified.
The Court cancelled the bail bonds of the convicts since they were present in the court as such, they were directed to be taken into custody and sent to Central Jail Srinagar for serving the sentence. “Requisite warrant is issued in the name of Superintendent Central Jail Srinagar for carrying out the sentence. The convicts are informed of their right of appeal against the conviction and sentence before the High Court within the prescribed limitation period”, reads the judgment.
The investigation of the case revealed that cousin brother of accused-Hamida Akhter paid Rs.60,000 to the Ghulam Mohammad Sheikh, then Junior Assistant Government High School, Goripora, through Mohammad Ashraf Khan in the year 1997 for her (Hamid’s) appointment in Education Department as a teacher.
Thereafter, the Ghulam Mohammad Sheikh and Mohammad Ashraf Khan hatched a criminal conspiracy with Assad-Ullah Lone of Ladhu Pulwama, then Headmaster, Government High School, Goripora (Now expired), Bashir Ahmad Shah, then Orderly Government High School, Goripora and Syed Showkeen Andrabi, then Orderly Government High School, Goripora and in pursuance of the conspiracy, managed the entry of accused-Hamida Akther in Education Department as a teacher by fraudulent and deceitful means.
The accused-Bashir Ahmad Shah and Syed Showkeen Andrabi prepared the Service Records of Hamida Akhter which was been authenticated by Forensic Science Lab. Meanwhile, Assad ullah Lone and Ghulam Mohammad Sheikh allowed her to join in Government High School Goripora, where they were posted as Headmaster and Junior Assistants without verifying the genuineness of order and drew the pay dues in favour of Hamida Akhther w.e.f 11/1997 to 4/1998 amounting to Rs. 29,952/- including the arrears w.e.f. 1/1996 to 12/1996.
