SRINAGAR, June 3: The trial court has sought reply to the plea filed by one of the members of Kashmir Chamber of Commerce and Industries (KCCI) challenging his termination from the membership of the body.
Former senior Vice President Kashmir Chamber of Commerce and Industry (KCCI), Nasir Hamid Khan pleads that he has been the elected member of the Executive Committee of KCCI since the year 2002 and was also elected as the Secretary General of the body in the year 2009 and Senior Vice President during the period 2017 to 2020.
Khan has approached the court after he has learnt from reliable sources that his request for restoration of membership of the body has been declined but till date the intimation has not been received by him but he seeks to call in question the validity and legality of the impugned decision taken by the body declining restoration of his membership.
He has prayed that his non-restoration of membership by the Executive Committee of the KCCI be declared as illegal, arbitrary and contrary to the bylaws of KCCI and immediate reinstatement of his membership effective from March 3, 2025 with all rights including contesting of future elections.
Plaintiff Khan submits that the decision of the body in its minutes of meeting on March 26 appears to be ambiguous and does not reflect exactly what the Executive Committee as he has no knowledge about his status in the body. “He apprehends that this conduct stems from resentment harbored by the certain office-bearers due to his earlier efforts in exposing financial irregularities within the KCCI”, he pleads
He pleads that there is misappropriation of funds, fraudulent withdrawal of Government grants by the presentation of fictitious bill in the body by some office-bearers which has caused losses to the institution and imposition of penalty of lakhs of rupees on three members of the present Executive Committee including President itself raises doubts the propriety of their functioning as office-bearers.
The case was initially presented before the District Judge, Srinagar, and has since been transferred to the Court of the 4th Additional District Judge. A caveat has been filed, and the court has issued notice to the respondents for submission of a written statement and objections. The next hearing is scheduled for 13 June, 2025.
