Misappropriation of token fees in RTO office

JAMMU, Nov 16: In a case of misappropriation of token fees in RTO office, Additional Sessions Judge Anticorruption Jammu OP Bhagat has returned the challan to the Crime Branch with direction to Senior Superintendent of Police Crime Branch, Jammu to conduct further investigation and file charge sheet without any delay.
The factual background of the case is that on 10-01-2009, an information was received from reliable sources that token fees deposited by the transporters/ owners at the rate of Rs 6000 is not reflected in the cash register and instead token fees of two wheelers at the rate of Rs 250 to Rs 500 is shown as deposited in the record maintained in the office of RTO Jammu and the balance amount is misappropriated.
Moreover, the driving licenses for passenger vehicles are issued on the basis of certificate provided by driving institutes and no objection certificate and attestations of Ist Class Magistrate (Naib Tehsildar) are being fabricated by the private agents.
The omissions and commission on the part of officers/officials of RTO Jammu as well as agent constituted offences under Sections 420, 465, 467, 468, 471, 201, 120-B RPC read with 5(2) of PC Act. Accordingly, a case FIR No.01/2009 was registered at Police Station Crime Branch Jammu.
During the course of investigation, all the seized records were scrutinized by an expert team of Finance Department deputed by Director Accounts & Treasury, Jammu and it was found that an amount of Rs 12,97,040 on account of one time token tax with effect from 01-04-2004 to 31-03-2005 was misappropriated with criminal intention of officers/officials who remained posted as Cashier and Accountants in RTO office, Jammu.
