JAMMU, Nov 3: Principal District and Sessions Judge, A K Koul has issued notices to 35 persons, who caused damage to the property of Leighton Welspun Contractors Pvt Ltd.
The notices were issued in a suit for damages filed by the company through their counsel Wasim Sadiq Nargal along with Advocates Priyesh Sharma, Vinay Kumar Sharma and Sahib Aggarwal.
In the suit, it has been mentioned that 35 defendants caused massive damage to the property of the company including vehicles, stores and following the incident FIR was registered against them on May 30, 2012.
The company also requested the Divisional Commissioner for deployment of two companies of paramilitary forces for Chenani-Nashri tunnel project in the light of the State Support Agreement.
It has also been mentioned in the suit that no arrest has so far been made by the police in the case registered on May 30, 2012 and the accused persons were moving free and committing breach of peace with impunity.
“Due to constant threat from the defendants and the incidents of vandalism and rioting the experts from outside the country have already gone away from the project site”, the company said in the suit, adding “it would be in the interest of the State and country if the project is completed within the time-frame”.
Mentioning that defendants have caused loss of Rs 15 crore to the company, the counsel for the company prayed before the court that a decree of more than Rs 15 crore along with interest be passed in the favour of plantiff and against the defendants.
After going through the suit and hearing Advocate Wasim Sadiq Nargal, the Court issued notices to all the 35 defendants.
