JAMMU, Oct 29: Principal Sessions Judge Jammu, Jang Bahadur Singh Jamwal today granted anticipatory bail to DySP Madan Mohan Singh, who was allegedly involved in kidnapping and land-grabbing case.
After hearing Advocate Rajneesh Oswal, the Principal Sessions Judge issued notice to Public Prosecutor for filling the police report as well as objections and ordered that in the meantime the petitioner shall not be arrested in the case FIR No 357/2012 under Section 364, 342, 149, 504, 506, 109 RPC. In the event of his arrest, the petitioner shall be released on bail on furnishing bail bond to the tune of Rs 25000 and personal bond to the like amount.
The Court directed petitioner to remain present in the concerned police station on October 30, 2012 at 10 am for the purpose of investigation and to seek further instructions from the Investigating Officer. He shall not make any effort to win over or influence the prosecution witnesses, the Court said, adding “if the petitioner makes any disclosure statement, he should be deemed to in police custody for purpose of Section 27 of Evidence Act”.
This order will remain operative till November 1, 2012.
Meanwhile, Forest Magistrate Adanay Sayeed has granted police remand of Madhu Sudan, son of Jai Ram and Arun Sudan alias Anku, son of Parbhu Dayal up to November 3, 2011 with the direction to IO that accused be medically examined after 48 hours.
