JAMMU, Mar 2: Chief Judicial Magistrate Kathua Amarjeet Singh Langeh today rejected bail application of Som Raj, son of Gopal Dass of Kathua, who was allegedly involved in attack on Naib-Tehsildar and police party.
After hearing both the sides, the court observed, “investigation shows that petitioner callously and without fear of consequences fired four gun shots on the team of revenue officials and police party”.
“To fire gun shots on team of officials who are out to perform official duty is a grave offence and falls within the fold of Section 307 of RPC”, the court said, adding “if likes of petitioner are admitted to bail in light of evidence collected by Investigating Officer so far, not only the Government officials out on duty be bullied and detered but the same would also have deplorable impact on the public at large, more particularly, when investigation is under way and further, apprehension of prosecution that if admitted to bail, petitioner shall flee from justice-does not seem to be un founded on facts. With these observations court rejected the bail application.
