Court convicts prosecutrix for perjury

RAMBAN, Oct 30: Principal Sessions Judge Ramban, Mohd Akram Choudhary, today convicted and awarded six months imprisonment and fine of Rs 5000 to one Kanta Devi for making false statement on oath which amounted to perjury punishable under Section 479-B CrPC.
In this order of wide public importance, the Principal Sessions Judge observed, “the prosecutrix had willfully and deliberately made a false statement to screen the accused from the punishment. She has made one statement on oath before the Magistrate and completely denied the same while being examined before this Court again on oath”.
After recording the judgment of acquittal, Court initiated suo-moto proceedings under Section 479-B CrPC against the prosecutrix and notice was issued to her to show cause as to why she should not be punished for offence for giving false evidence.
After considering the submissions of Public Prosecutor G N Manhas and defence counsel A H Yattoo, Court observed, “it has been proved that the accused made two contradicting statements on oath, one during investigation in terms of Section 164-A CrPC and second before the trial court. The prosecutrix in the trial court turned hostile and denied that she was kidnapped or raped”.
Taking a lenient view looking into the young age of prosecutrix, the Court convicted her for a period of six months and imposed fine of Rs 5000.
