JAMMU, May 27: 1st Additional Sessions Judge Srinagar Anjum Ara today awarded six years rigorous imprisonment to Touseef Ahmed Sofi and Mohsin Sidiq Sofi and more than two years to Farooq Ahmed Sofi under 304-II IPC (culpable homicide not amounting to murder).
According to the police case, on 25-07-2018, one Mudasir Ahmed Sofi and his father Noor-ud-Din Sofi in the injured condition approached police with written complaint mentioning that they had dispute over a piece of land with Farooq Ahmed Sofi and in this regard a civil suit was pending in a court of law and they were attacked by accused persons.
On receipt of this written information, FIR was registered and the injured persons were shifted to hospital where Noor-Ud-Din Sofi died after some days. During investigation, the offences under Sections 302, 341, 34, 147, 148 RPC were found established against accused.
After hearing both the sides, the court observed, “it is proved beyond any shadow of doubt that the death of deceased was homicidal in nature and death was caused by the act of accused persons with the knowledge that it is likely to cause death”, adding “the prosecution has been able to establish and prove the guilt of the accused persons for commission of offences under Section 323/304 Part- II/34 RPC”.
Accordingly, court awarded the sentence to the accused.
