Court awards 10 yrs imprisonment in rape case

JAMMU, June 17: Principal Sessions Judge Ganderbal Abdul Nasir today awarded 10 years imprisonment to Ghulam Mohammad Lone in a rape case and imposed fine of Rs 1 lakh.
As per the prosecution case, on 13-04-2017 a complaint was lodged with Police Station Kangan to the effect accused committed rape on orphan girl of Chattergul due to which she became pregnant. Accordingly, FIR No.27/2017 for offences under Sections 376/447 RPC was lodged.
After hearing both the sides, the court observed, “it is proved beyond all reasonable doubts that the accused has committed sexual intercourse with the victim on the false promise of marriage without having intention to marry the victim. Therefore, accused is convicted for the commission of offence under Section 376 RPC”.
“While considering the circumstances and facts of this case, this court is of the opinion that the offender has spoiled the life of victim under the promise of marriage, which was turned down by the offender once the victim became pregnant, therefore, the offender deserves no leniency. The offender is sentenced to simple imprisonment for 10 years and a fine of Rs 1,00000 lakh is imposed for the commission of offence under Section 376 Ranbir Penal Code”, Principal Sessions Judge said.
