SRINAGAR, Oct 24: A local court in Handwara in Kupwara district of North Kashmir today sentenced a cop to 11 years of jail and fine of one lakh rupees for drug trafficking.
The Additional Sessions Judge Handwara presided over by Mansoor Ahmad Lone convicted the accused cop Mushtaq Ahmed Pir of Kalmoona, Tarathpora for commission of offices under NDPS Act and sentenced him to undergo rigorous imprisonment for a period of 11 years.
The court has also fined him with Rs 100000. “In default of payment of fine, the accused shall further undergo simple imprisonment for a period of six months”, read the judgment.
Since the accused-Pir has already spent 5 years and 2 months and 22 days in custody therefore, the court clarified that the said period shall be set off against the substantive 11 years sentence of imprisonment awarded to him. Click here to watch video
As per prosecution case that on July 12, 2019 a team from police post Chogal was performing duty Ganderbal Road in connection with the general checkup of the movement of vehicles and during that time a Santro Car was moving from Sopore towards Kupwara side and during search, the police recovered some contraband like substance under the bonnet of the said vehicle.
During the course of investigation, the seized property consisting of one cloth packet of brown Sugar was weighed on spot through scale and total weight was recorded as 750 grams. During the custody of the accused, he has given a confession before the police and further recovery of 50 gms of heroin and counterfeit currency were made from the residence of the accused person and after completion of investigation the charge sheet was presented before the court for trial under NDPS Act.
The court in view of the facts and evidence said the prosecution has proved and clearly established beyond reasonable doubt the guilt of the accused person who has committed the offence under NDPS Act. “This court does not find any alternative than to convict the accused person for the commission of offences punishable under NDPS Act for recovery of heroin in the instant case registered by the police station Handwara against him under case FIR No. 188/2019”, read the judgment.
