Contempt of court against Agri Deptt officials

Srinagar, Dec 19: The High Court today framed rule under Contempt of Courts Act against the higher officials of Agriculture Department Kashmir and sought show cause from them as to why they may not be punished.
Justice Ali Mohammad Magrey while dealing with a contempt petition seeking implementation of judgment of the year 2015 said the authorities prima facie are found to have committed contempt of court and as such directed the Registry to frame rule against Commissioner Secretary Agriculture Production Department, Director Agriculture Kashmir, Chief Agriculture Officer Anantnag and Mushroom Development Officer to show cause as to why they shall not be punished for committing contempt of court.
Senior advocate Syed Faisal Qadri for petitioner-Mohammad Yousuf Mir submitted before the court that the petitioner shall be brought on regular temporary establishment in terms of rules notified vide SRO 64 of 1994 within eight weeks in case recommendation is made for regularization of his services.
“…It is very painful to notice that despite strenuous efforts made by the petitioner with regard to his legally sustainable claim, as held by this court in multiple rounds of litigation, the petitioner has not been able to reap the benefit of the said litigation”, Justice Magrey observed.
He said there is no sincere endeavour and effort made by the authorities to ensure that the orders of the court in the case are factually and actually implemented and mere issuance of order by the Director Agriculture Kashmir, which is not even implemented by his subordinate officer, does not, in any manner amount to implement the orders of court passed from time to time.
Court apart from framing rule also directed that all the officials shall also remain present in person before the court on each hearing day of the case till the contempt proceedings are taken to its logical end.
Court also made it clear that in the event the officials fail to appear before the court on next date of hearing, the court shall have no other option but to have recourse to coercive measures for securing the presence of these officials before the court.
