JAMMU, Oct 12: Chief Judicial Magistrate Jammu Ashwani Sharma has rejected the bail application of husband in dowry death case.
While rejecting bail application of Shahid Ali, S/o Mohd. Khan, CJM Jammu Ashwani Sharma, after hearing Senior PO Rohit Gupta for the State, observed, “the accused are involved in case FIR No.91/18 for the commission of offences U/S 498-A/304-B RPC”, adding “during the inquiry it has established that the death of deceased by consumption of poison has been caused due to the cruelty, torture, beating coupled with demand of dowry by the applicant and his brother namely Bahdur Ali”.
“Thus, commission of offence U/S 498-A/304-B RPC has been established against the applicant. The accused is in the custody of police from 23.09.2018. Since, the accused is involved in the commission of offences U/S 304-B/498-A RPC which are heinous in nature and are committed against the society at large and if the accused is enlarged on bail, the same shall shatter the trust of the family of victim and common people in the judiciary”, the court said.
