Charges framed against 6 for attempting attack on forces

JAMMU, Mar 8: Special Judge NIA Subash Chander Gupta has framed charges against six persons for planning and attempting to carry out suicidal bombing on the convoy of the security forces on the National Highway in Banihal area early last year.
As per the NIA case, these accused persons, who were associated with the Hizbul Mujahideen outfit hatched conspiracy among themselves for carrying out suicidal bombing on the convoy of the security forces plying on the national highway.
Accordingly, in the month of March last year, they made two different attempts but failed to succeed in their nefarious designs and later one of them was arrested from Jawahar Tunnel area while travelling in a vehicle. On his interrogation, other accused were also arrested.
After completion of investigation in the case, NIA presented charge-sheet in the court of Special Judge NIA.
On deep analysis of the relevant record of the final report of the investigation forming part of the charge-sheet of the NIA, the Special Judge observed, “allegations appear to have been proved by the investigating officer against the accused by sufficient cogent and consistent evidence”, adding “sufficient grounds are existing for drawing presumption that the accused have committed offences under Sections 309 and 307 RPC, 3&4 of Explosive Substances Act, 4 of J&K Public Property (Prevention of Damage Act, 1985) and 16, 18, 20, 23 and 38 of Unlawful Activities Prevention Act read with Section 120-B of RPC”.
The accused persons are Owais Amin alias Cherry, Umar Shafi, Aqib Shafi Shah, Wasim Ahmed Dar, Hilal Ahmed Mantoo and Sahid Ahmed Wani alias Watsom.
Each of these accused denied the allegations incorporated in the charge-sheet and insisted for facing the trial. Accordingly, the case was adjourned for prosection evidence and accused were sent back to the concerned jail with the direction to the Superintendent to produce them on next date of hearing—March 24, 2020.
