CAT seeks report on appointments of Dy Medical Suptds in GMCs

SRINAGAR, June 3: The Central Administrative Tribunal (CAT) has directed the committee to submit the report before it with regard to clarification of qualification for filling the post of Deputy Medical Superintendents in Government Medical Colleges in Jammu and Srinagar.
The Division Bench of M S Latief (J) and Prasant Kumar (A) allowed the prayer of committee for extension of time in submitting the report before the bench as the counsel for Public Services Commission (PSC) produced a report before the bench which reveals that as regards the experience certificates of all the candidates, who had applied for the post of Deputy Medical Superintendent, whose experience certificate was accepted by the Commission, the committee has only submitted a tabulated form, wherein, one of the cases, Dr. Ifra Khalil Kangoo, the experience as reflected in the Committee’s Report is “Assisted the Medical Superintendent SKIMS in running the administrative affairs of the hospital.” and the same has been accepted by the Commission as being valid likewise in other cases also.
The bench said that the committee has not clarified, as to whether the experience of assisting the Medical Superintendent, SKIMS in running the administrative affairs of the hospital is a required qualification in terms of the advertisement notice and likewise as regards others also, the same has been reflected in the report of the committee.
“Keeping in view the prayer of the committee for extension of time, we allow further time by two weeks as prayed for. At the same time, we direct the Principal, GMC, Anantnag to expedite the submission of required information to the Chairman of the Committee (Director, SKIMS, Soura, Srinagar) expeditiously. It is expected that the committee will comply with the directions passed by this court as also the Govt. Order dated 25.04.2025 by providing with the complete expert opinion/final report, as sought for, which would include the petitioner-Dr Kulbir Singh as well as all those candidates whose experience and qualification have been accepted by the Public Service Commission. The report be submitted in a sealed cover before this court”, CAT directed.
It is noted that the Government in compliance to the directions passed by the Central Administrative Tribunal, Srinagar Bench, accorded sanction to the constitution of the committee comprising of various officers to clarify the qualification prescribed for the post of Deputy Medical Superintendent in Jammu & Kashmir Medical Education (Gazetted) Service Recruitment Rules, 1979 notified vide SRO 517 dated 19.09.1979, especially the term “experience of running a hospital”.
The committee is headed by Director, SKIMS Soura, Srinagar as its Chairman, Principal, Government Medical College Jammu- Member, Principal, Government Medical College, Srinagar- Member, Secretary, J&K Public Service Commission- Member and Director (Coordination) new GMCs- Member.
Dr. Kulbir Singh has preferred the plea before the CAT seeking appointment on the post in question. The issue involved in the matter is the J&K Public Service Commission (PSC) issued a notification dated 07.11.2023 for filling up the posts of Deputy Medical Superintendent in Government Medical College, Srinagar/Jammu.
The qualification prescribed for filling up the posts are part of the notification, wherein the qualifications and the experience as required are prescribed as regards the qualification for filling up the posts in question, the candidate has to be post graduate in Surgery/ Gynecology/Medicine and/or other clinical subject/Hospital Administration and the experience required is three years working experience of running a hospital after post graduation.
The committee as regards the experience of the petitioner-Singh submitted that the experience certificates provided by the Principal, GMC, Anantnag, although seems to qualify for running the hospital but the dates of experience certificates issued are not explicitly clear.
Therefore, the committee after threadbare discussions and perusal of all the documents decided that: a separate letter in a sealed envelope be sent to the Principal GMC, Anantnag to get clarification for the period of experience of the applicant, Dr. Kulbir Singh Jatt.
The committee resolved to send experience certificates of all other eligible candidates to the respective issuing authorities for verification and also decided to make a request to the Tribunal (CAT) to grant two more weeks until the above information sought is made available by the concerned quarters.
