CAT questions Labour Deptt over withholding of gratuity, warns of penalty

JAMMU, June 12: A Bench of Central Administrative Tribunal (CAT) comprising Rajinder Singh Dogra (Member Judicial) and Ram Mohan Johri (Member Administrative) has pulled up the Labour and Employment Department for failing to release gratuity to a retired official namely Kamal Mahendru more than three years after disciplinary proceedings concluded.
Mahendru had requested that a penalty amount of Rs 2,14,250-imposed after departmental proceedings in 2022-be deducted from his gratuity, with the remaining amount to be released. Despite assurances, no amount has been credited to his account, causing him severe financial hardship.
Taking serious note of department’s inaction, the CAT has directed the respondents to appear personally on the next hearing date—-June 30, 2025 and explain why cost of Rs 50,000 be not imposed on them for harassing the applicant and not settling his case till date.
