CAT orders reinstatement of Tehsildar

JAMMU, Nov 28: The Central Administrative Tribunal has directed the Government to reinstate Tehsildar Subhash Singh Chib, who was forcibly retired in 2016 on corruption charges.
The tribunal has also ordered the Government to provide Chib with all benefits within two months.
The tribunal’s judicial member, Sanjeev Gupta, and administrative member, Pragya Sahay Saksena , issued a 16-page order quashing the forcible retirement order (No. 1265-GAD of 2016) and directing Chib’s reinstatement with all benefits.
Chib was accused of creating fake permanent resident certificates and corruption in the allotment of Government land. However, the tribunal found that the charges against him were not proven, and his compulsory retirement was unjustified.
The tribunal’s order stated that the Government’s decision to compulsorily retire Chib was punitive and not in the public interest. It also noted that Chib’s service record was clean, and he had been rated as an excellent and dedicated officer by his superiors.
The Tribunal cited several similar cases, emphasizing that when evaluating a Government official’s character, their record should be presented in the correct context. Only an officer who closely observes another officer’s work and behaviour daily can claim that the officer is not dedicated. Merely citing a registered case to justify punitive action while ignoring the officer’s service record indicates that the punishment was given without due consideration.
The Tribunal has directed the Government to complete Chib’s reinstatement within two months of the order’s issuance.
