SRINAGAR, Oct 3: Special Judge (Designated Court under NIA) Anantnag Khalil Ahmad Choudhary has denied bail to one Zubar Ahmed Lone, son of Mohammed Aslam Lone of Kulgam, who was booked under Unlawful Activities (Prevention) Act.
According to the police report, the accused had organized a group and was collecting money for anti-national activities and making plans for attacking the security forces.
After hearing counsel for the accused and Public Prosecutor, the Special Judge NIA observed, “perusal of police report reveals that applicant/accused is allegedly involved in the offence under ULAP Act and is instigating the youth for indulging into antinational activities”, adding “there are reasonable grounds to believe that the accused is involved in instigating the youth for indulging into unlawful activities and charge sheet is yet to be presented against the accused”.
“His release will amount to increase and development of militant organizations as the country most particularly UT of J& is already in the firm grip of spiraling terrorist violence and is caught between deadly pangs of disruptive activities”, the court said, adding “terrorism is an evil affecting the life and liberty of peace loving people”.
“Offences against individuals are to be distinguished from offences affecting nation and people at large. Parameters to be adopted in the matter of considering the pleas of bail would also be different in these cases”, the court said, adding “a strict approach in the latter category of cases is justified. Sympathy has no rule in dealing with such cases”.
Quoting several judgment of Supreme Court, the Special Judge NIA said, “on analysis of the matter in its totality, I am of the considered opinion that applicant/accused has failed to establish a reasonable and cogent ground for grant of bail at this stage”.
Accordingly, the court rejected the bail application.
