JAMMU, Feb 6: Special Mobile Magistrate Passenger Tax Court Jammu Sandeep Gandotra today rejected the bail application of one Manzoor Hussain Qadri, who was running job racket and duped the innocent youth on the pretext of providing Government job.
After hearing both the sides, the Special Mobile Magistrate observed, “the court in such case cannot pass a blanket order of bail because the court cannot go beyond the statutory command of law more so when the faith of general public and unemployed youth of the country is involved”.
“Enlargement of accused on bail at this stage would scuttle the investigation because the huge amount of money has yet not been recovered and co-accused persons namely Mushtaq Ahmed, Showkat Qureshi, Fiaz Ahmed Dar, Mumta Devi and Jasbir Singh are still absconding”, the court said, adding “even otherwise the grant of bail at this stage would not be in public interest, which is a paramount consideration”.
“Keeping in view the nature of allegations, character of evidence collected by IOs, stage of investigation, the fact that co-accused persons are still absconding, the fact that an amount of Rs 33 lakh has not been recovered and involvement of public interest, this court is of the opinion that discretion of bail in favour of accused cannot be exercised at this stage”, the court said while rejecting the bail application.
