Arguments begin in Rubiya Syed kidnapping, IAF men killing cases

JAMMU, Feb 3: More than 30 years after registration of Rubiya Syed kidnapping and Air Force men killing cases, arguments on charge/discharge started in the TADA Court today.
After partly hearing the arguments, the Presiding Officer TADA Court Subash C Gupta adjourned the case for February 24 for further arguments and directed jail authorities to produce the accused namely Yasin Malik and Shoukat Ahmed Bakshi preferably personally if not possible for security or other reason through video conferencing on next date of hearing failing which they have to explain in this regard.
As per the FIR, Dr Rubiya Syed, daughter of late Mufti Mohammad Syed was kidnapped when she was travelling in a mini bus bearing Registration No. JKF 697 from Lala-Ded Hospital Srinagar to her house at Nowgam.
On 18.09.1990 the charge sheet in this case was filed by CBI under Section 120-B read with Section 364, 368, 109 and 34 of RPC, Section 3(1) TADA and Section 27 of Arms Act in the court of 3rd Additional Session Judge (TADA cases Jammu) against the accused persons.
During the course of trial a petition dated 25.10.2008 in terms of SRO 168 dated 01.05.1990 read with SRO 70 dated 05.02.1991 for transfer of the criminal case to the designated Court of TADA at Srinagar was filed. Objections to the application were filed by the CBI and after hearing both the parties the application was rejected vide order dated 20.04.2009.
Against the order of trial court the petitioners approached the High Court at Srinagar on 30.04.2009 and the High Court stayed the proceedings of the trial court.
The Indian Air Force personnel were killed on 25.01.1990 in Rawal Pora area by some militants when they were waiting for the official vehicles to go to their office.
