Alliance, BJP MLAs clash, trade charges after Pathania terms Art 370 a temporary provision

NC accuses BJP of using un-Parliamentary language against Dy CM

JAMMU, Feb 10: The National Conference (NC) and Opposition BJP members clashed in the Assembly here, today during the debate on annual budget when BJP MLA from Udhampur East, Ranbir Singh Pathania said Article 370 was a temporary provision in Indian Constitution. He, while quoting the Constitution in this regard said it has been mentioned in the Indian Constitution that the Article 370 was a temporary provision and record of the House must be set straight as since this debate the members have been repeatedly mentioning Article 370.
He said the then Prime Minister, Pt Jawahar Lal Nehru had himself termed Article 370 a temporary provision saying “It has been eroded and Jammu and Kashmir has been integrated’’. Even another former Prime Minster and a veteran leader, Gulzari Lal Nanda had termed “Article 370 a shell’’, he added.

Besides, former Prime Ministers, Morarji Desai and Choudhary Charan Singh and former Chief Minister of Tamil Nadu, J Jayalalitha had also said on the floor of Parliament that “If Article 370 was a temporary provision it should be abolished’’.
Objecting Pathania strongly, Congress MLA from Bandipora, Nizam-ud-Din Bhat stood up from his seat raising a Point of Order(PoI ) and strongly countered the BJP MLA. There was a verbal duel between the two. However, Pathania did not budge. He also vociferously countered the Congress Legislator saying “We can’t mislead the House as there was an agreement during Accession,’’.
Supporting Bhat, NC’s Nazir Gurezi also stood up to join him and entered into a verbal duel with Pathania and hooted him down. Taking strong exception to it, BJP MLAs also stood up from their seats to defend Pathnia and retorted back. A high drama prevailed for some time with NC and Congress members also on their toes to take on BJP legislators and both sides were engaged in hooting each other down. Meantime, Mubarak Gul of NC also made a remark but it was lost in the din. NC’s Tanvir Sadiq while countering BJP Legislators said they were misleading the House. He was strongly countered by BJP’s Sunil Bharadwaj.
The brawl between the two sides continued with NC MLAs accusing BJP of misleading the House. “Don’t mislead the House’’ the NC MLAs said oft repeatedly.
Countering the alliance MLAs, BJP’s Balwant Singh Mankotia took serious exception to their behaviour saying that they NC and Congress MLAs should talk on their turn instead of disrupting BJP Legislators. He asked them “Why you stand up at every now and then,’’.
Meanwhile, Altaf Kallu of NC also accused BJP MLA, Dr Narinder Singh of using un-Parliamentary language when later passed a remark against Dy CM. Narinder Singh was also strongly countered by Dy CM and both were engaged in heated exchanges for some time.
BJP’s Sham Lal tried to intervene terming the happenings in the House unfortunate. He pointing towards NC benches said “You always disrupt the House,. You said there was never Dogra rule in J&K. (Dogroon Ney Kabi J&K Per Rule Nahin Kiya Hain),’’. Your Minister said “The minority can’t rule majority,’’ an agitated Lal said while quoting the NC Minister’s recent statement.
As Sham Lal was speaking Dy CM intervened saying Pathania considers that he is the only intelligent and the un-Parliamentary language used by one of the BJP MLAs should be expunged.
Pathania, while countering NC Legislators said “If I am incorrect they can take any action against me, even impeach me, but they should allow me to speak. The BJP is for constructive opposition,’’ he added.
While countering NC leaders Pathania made some references from Gulab Nama and Mahabharta saying that Amritsar Treaty was signed by Maharaja Gulab Singh a great Dogra warrior.
He said the reference of J&K is in Mahabarta and the then Kashmir ruler did not join both Kauravas and Pandavas in the war of Mahabharta at that time as he opposed war. Pathania, while referring to CM said he Omar Abdullah has said National Law University (NLU) will be established in Kashmir and demanded there should be two NLUs one each in Kashmir and Jammu region. The Government has power to establish two NLUs, he added.
He said Indian Constitution is Ram Rajya Model and Ram does not belong to any religion as was also said by NC president, Dr Farooq Abdullah earlier.
Maintaining that India is a land which belongs to everyone, he said Vande Matram is our national song and great freedom fighter Ashfaqullah Khan embraced gallows during war of India’s Independence while reciting Vande Matram. Even veteran leader and first Education Minister of India, Abu Kalam Aazd had recited Vande Matram and great Urdu poet of Sub Continent, Alama Iqbal had described Ram as Imam-e-Hind. He said this is the idea of India and we have to think about the idea of India.
He said Muslim saint Shah Hamdan, Shiv Yogni Lal Ded, Sofi saint Nund Rishi, Abhinav Gupta a great Shivait were the idea of India.
Meanwhile, there were again heated exchanges as BJP MLA, Dr Narinder Singh passed some remarks about Dy CM. The BJP MLA turning to Dy CM said your family is in mining business and again uproar was witnessed in the House with both sides levelling charges against each other.
The NC legislators stood up from their seats to defend Dy CM and countered BJP Legislators again. In the meantime there were again heated exchanges between BJP ‘s Narinder Singh and Dy CM and both used un Parliamentary language against each other.
Taking on BJP members NC Legislators demanded apology from Narinder Singh for passing un Parliamentary remarks against Dy CM .
Speaker Abdul Rahim Rather asked BJP members to calm down and take their seats. After Speaker’s direction order was restored in the House and Pathania continued his speech and suggested measures for making J&K and economically viable UT. He made a dig at Government of outsourcing 24,000 jobs and this way it played with future of unemployed youth in the UT.
As Pathania was speaking BJP’s Narinder Singh again stood up from his seat and started making a clarification but he was reprimanded by the Speaker.
Intervening Minister of Education and Health, Sakina Ittoo said that Opposition should tender apology to Dy CM for using un Parliamentary language against him. She said the word used by
BJP MLA against Dy CM should not have been used.
