JAMMU, Jan 22: Principal Sessions Judge Jammu Kartar Singh has acquitted Mohd Hayat Bohru, son of Atta Mohd Bohru of Chambalwas Banihal, alleged ISI trained militant as prosecution miserably failed to prove its case.
According to the police case, on December 2, 2007 Nagrota Police laid a naka near TCP Bye Pass and intercepted a car. From the vehicle, police recovered one pistol, two magazines of pistol and 11 live cartridges. From the personal search of driver, an identity card in the name of Imtiaz Ahmed Sohail and one mobile were also recovered.
On enquiry he disclosed his name Mohd Hayat, son of Atta Mohd of Chambalwass Banihal and revealed that he got training through ISI in handling of weapon in Pakistan in order to cause militancy activities in the State and to commit murder of innocent persons of Jammu.
After hearing Public Proseuctor Shabir Choudhary for the State whereas Advocate OP Thakur appearing for the accused, Principal Sessions Judge Jammu observed, “prosecution has miserably failed to prove its case against the accused beyond any reasonable shadow of doubt”, adding “the investigation is tainted and leads the court nowhere”.
“It has not been proved by the prosecution as to who has conducted investigation in this case and whether the grenades recovered on the disclosure statement of the accused or not. The facts of the case are so intermingled that it is difficult for the court to separate the grain from the chaff”, Principal Sessions Judge said.
With these observations, court acquitted the accused of the charges framed against him. “The seized arms and ammunition shall be deposited in the District Armory, whereas the seized identity cards and mobile phone shall be destroyed but only after the expiry of period of appeal”, the court added.
