DODA, Aug 29: Additional Sessions Judge Doda Archana Charak today rejected bail application of accused Amjad Ali, son of Mubarak Ali and Vikas Ishfaq, son of Ishfaq Ahmed who were allegedly involved in NDPS Act registered with Police Station Doda and heroin (Chitta) weighing 26 gms was recovered from their possession.
Additional Public Prosecutor apprised the court that petitioners are hardcore criminals against whom number of NDPS cases are pending in the court for trial.
Additional Sessions Judge observed, “the offence committed by the accused is punishable with imprisonment not exceeding 10 years and to such a case rigor of Section 37 of the NDPS Act does not apply”, adding “it is a case where the petitioners have been found previously involved in cases of similar nature arising out of FIRs registered at different police stations for having committed same offence/s under NDPS Act and similar offence they have committed 4th and 2nd time respectively there by breaching the condition of previous bail orders”.
“So it is a case where the petitioners after their bail in the previous cases within a short span of time have been found to have committed repeatedly the offence of carrying a huge quantity of narcotic substance”, the court said, adding “the petitioners according to the IO are notorious criminal and drug peddlers and three cases of NDPS are already pending in the court against accused Amjad Ali and one case of NDPS Act is already pending disposal in court of Batote against accused Vikas Ishfaq”.
“The offences committed by the accused are serious and heinous impacting the society at large, particularly the young generation. The drug menace is eating the young generation like a termite”, the court said, adding “the applicants cannot be given the concession of bail, as such the application for grant of bail being devoid of merit is rejected”.
