Accompanying accused with choice not abduction: Court

JAMMU, July 10: Fast Track Court Jammu has acquitted accused Sikander Solanki for offences of abduction and rape in a case pertaining to year 2019. Allegations against accused were that he abducted prosecutrix and lured her away on 16.07.2019 from Bikram Chowk Jammu and took her to Delhi, Rajasthan and Mathura and also committed rape on her.
While dismissing the challan, court held that prosercution evdicence clearly demonstrated that alleged victim was consenting party in elopement with accused and she as such willingly and with free choice accompanied him. “For an adult girl to accompany and remain with accused with choice is distinct from abduction and rape”, court further added and dismissed prosecution case as “trumped-up story” and acquitted accused.
In another case instituted in the year 2011, Fast Track Court Jammu also acquitted one Ram Lal who was facing trial for rape charges. While dismissing the case, Presiding Officer of fast track court, Amarjeet Singh Langeh, Session Judge- held that testimony of victim in the case is wholly unbelievable as her conduct is extremely un-natural and her version is laden with inherent absurdity. After critically analysing the evidence produced in the case, court further ruled that prosecution case has no ring of truth in it and with these obervations, it dismissed the challan.
