HC seeks report on lawyers chambers

Srinagar, Feb 22:  High Court has sought personal affidavit from Secretaries of Finance and Law Departments indicating therein as to why the additional lawyers chambers in new district court complex Srinagar are not feasible.
The Division Bench of Justice Ramalingam Sudhakar and Justice M K Hanjura sought personal affidavit from Secretaries of Finance and Law Departments after the perusal of response, in which it is stated that the construction of additional block of chambers for lawyers at district court complex is not feasible for financial constraints.
DB said the statement made in the response of Government is vague and bereft of details not supported by any material either from the Finance Secretary or the Chief Secretary of the State.
“We therefore, call upon the Secretaries of Finance and Law Departments to file their personal affidavits as to why proposal of additional lawyer’s chambers at Moominabad is not feasible”, court directed.
“What is the nature of financial constraints is not forthcoming from the status report and the office of the Advocate General has already been established long before and we, fail to understand as to why they should include it in the present status report,” the DB said.
“Therefore, we find the status report is not in tune with the earlier order and does not address the judicial order in the right perspective”, reads the order.
Court insofar as the regularization of judiciary daily wagers is concerned, directed the Government in view of earlier orders passed by the court in this connection, to conclude the process on or before the next date and file the compliance report.
With regard to regularization of daily wagers, court is seeking implementation of observations made by Supreme Court in which State Government has been held responsible for creating such situation as large numbers of persons are working as daily wagers in the judiciary for more than 10 years.
