HC quashes order of SSB

JAMMU, Feb 3: High Court has quashed the order of Jammu and Kashmir Services Selection Board whereby candidature of the petitioners from selection zone was withdrawn.
The order was passed in a petition filed by Pitambar Lal and others.
After hearing both the sides, Justice Alok Aradhe observed, “the selection of the petitioners was cancelled by SSB on the basis of representation made by one Mohd. Kabir. It is further submitted that neither any notice was served on the petitioners nor an opportunity of hearing was afforded to them before cancellation of their appointment”.
“On the other hand, counsel appearing on behalf of the respondents submitted that he is not aware about the fact as to whether any opportunity of hearing was ever afforded to the petitioners or any notice was issued to them before cancellation of their appointments”, the High Court observed.
Justice Aradhe further observed, “in the facts of the case, the impugned order dated 04.02.2011 being in flagrant violation of the principle of natural justice is hereby quashed”.  High Court also directed SSB to afford an opportunity of hearing to the petitioners as well as the complainant and thereafter take a decision in accordance with law within a period of two months from the date of receipt of the order passed today.
