Srinagar, Dec 19: High Court today directed the Law Department to examine the objections received to the draft policy for protection and providing Constitutional rights to transgenders in the State.
The Division Bench of Justice Mohammad Yaqoob Mir and Justice Ali Mohammad Magrey while hearing PIL for providing protection and fundamental rights to transgenders directed the draft policy be also submitted to the Court.
Court during the proceedings of the case has been informed that the Government has framed a draft policy on the issue and the same has been sent to the Law Department.
However, petitioner was present in person before the Court and submitted that the said draft policy is not in tune with the Supreme Court directions and he has certain objections to the said policy.
”Whatever objections he has, shall be submitted before the Law Department where the draft policy has been sent and a copy be filed in this court also. In case any copy of objections is received by the Law Department, same shall be examined”, DB directed.
Petitioners have approached the Court of protection of Constitutional rights of transgenders in the State and prayed that the State Government be directed to implement the judgment of Apex Court passed in a petition titled National Legal Services Authority Vs Union of India, in this connection in letter and spirit.
They, in their petition submitted that the State Government is duty bound to fulfill their necessities and till date it has failed to provide any concrete relief to them.
They further sought directions to the Government for determining the exact number of transgenders in the State besides a guaranteed quality life in terms of political, social and economic standards so that no transgender is subjected to any form of discrimination, injustice or violence.
“The Government should acknowledge the transgenders of Jammu and Kashmir as a marginalized and vulnerable section and therefore introduce reservations in educational institutions and Government jobs for them,” the PIL read.
