CB produces challan against Patwari, notorious cheat

JAMMU, Oct 26: Crime Branch today produced challan against a Patwari and a cheat for committing forgery and indulging in corrupt practices.
According to the Crime Branch spokesman, the case against Patwari namely Rashpal Singh, son of Waryam Singh of Dhera, Akhnoor and Sarwan Kumar, son of Gian Chand of Nai Basti, R S Pura was lodged by Rajji Devi, wife of Nanak Chand of village Kapoorpur, R S Pura.
In the complaint, it was mentioned that Rajji Devi was in possession of 32 kanal land at village Kapoorpur, which was allotted to her husband. It was alleged that Patwari and Girdawar Halqa Kapoorpur in connivance with Sarwan Kumar changed the Girdawari entries in revenue record on the name of Sarwan Kumar in order to deprive her of the landed property.
During preliminary verification by the Crime Branch the allegations were substantiated and criminal offences prima facie proved. Accordingly, the case was registered and further investigation was set in motion.
During the course of detailed investigation, statement of the complainant was recorded wherein she stated that she was in need of some money so she entered into an agreement with the help of some reasonable persons of the village with one Sarwan Kumar and obtained an amount of Rs 1,10,000 as loan from him with the condition that for a period of three years the accused person will cultivate/use her 20 kanal land for agricultural purposes and receive the harvest as interest of the loan amount and after the prescribed period as per the agreement the money will be returned and the possession of land will be taken back.
After the completion of three years, Rajji Devi along with Chowkidar Halqa went to Sarwan Kumar to return his money for taking her land back but Sarwan Kumar refused to take money back and told that the land in question was existing on his name. On this, the complainant approached the Patwari concerned and asked for the status of the land. The Patwari initially refused to provide information, but on persuasion he stated that Girdawari of land was existing on the name of Sarwan Kumar since Kharif 1998.
The records pertaining to the land in question were requisitioned from the Tehsildar concerned and Patwari Halqa Kapoorpur, R S Pura and seized in the case. The records revealed that the Girdawaries of the land were changed by the Patwari concerned of that time from the name of the complainant to the name of accused Sarwan Kumar to give him undue benefit.
As per Land Revenue Act and circular issued by the Financial Commissioner, no revenue official below the rank of Tehsildar can change the Girdawari of any land. The same thing has also been stated by the then Tehsildar R S Pura which clearly indicated that a fraud has been committed by the then Patwari Halqa Kapoorpur, R S Pura to give undue/wrongfull benefit to Sarwan Kumar for certain extraneous consideration.
