SRINAGAR, June 23: Hundreds of people who had booked flats at Palm Riviera in Sidhra area of Jammu have been left in lurch as the company has built the muti-storied structures illegally on Agriculture land.
A Rajasthan based company, Adarsh Builder State, has built multi-story buildings for residential flats, Palm Riviera, on Agricultural land in Sidhra area illegally against the directions of the High Court.
The construction was started in 2013 but the project got stalled last year after a resident raised the issue before the High Court.
The project was started without getting land use change, though the Jammu Municipal Corporation and Jammu Development Authority have provided the permission for the construction of the flats with the condition that the builder will obtain the land use change first and then only they can start the construction.
After the matter was taken to High Court which stayed the project, the builder applied for the change of land use for construction of residential flats while the structures have already been erected illegally.
As the builder applied for the change of land use, the Assistant Commissioner Revenue Jammu in his letter (dated 14-01-2016) to Chief Agriculture Officer Jammu has sought no objection certificate from him.
Now the file for the change of land use is lying with the Revenue Department and the builder is trying hard to get it changed so that he can go ahead with the construction.. Since the change of land use has been banned and it is beyond the purview of Revenue Department, the builder is now trying hard to get Cabinet nod for the change of land use against High Court directions.
The company has sold around 300 flats to people in Jammu and Srinagar but they allege they have been cheated. One of the persons who has booked a flat at the Palm Riviera told Excelsior that he deposited Rs 30 lakh with the company and was assured that he will be given possession in 2016. He said that the work on the project has been stopped a year ago and builder is giving them false assurances. “What is our fault? We have paid for the flats. We hardly know they have come up illegally”, he said.
The Manager of Company, Chandersh Kumar, told Excelsior that the work on the project has been stopped after dispute over change of land use. The issue will be resolved in few days and we will re-start the work on the project. We will complete it by the end of next year and hand over possession to the people who have booked the flats”, he added.
