Compulsory retirement

Sir,
Refer your news item “HC quashes compulsory retirement” DE Dec 23. The Govt has been issuing orders to the Government employees of various departments for compulsory retirement after declaring them as “dead wood” without proper deliberations and never thinking that the courts are there to go deep into the intricacies of such matters. It is in view of such decisions that the High Court has quashed compulsory retirement of 21 more Govt officials with the direction to the State to reinstate the petitioners and award them all the consequential benefits within a period of one month. The order of the High Court would have embarrassed the Govt authorities in certain such cases wherein APRS of the concerned officers have not been fully studied. Previously also, the Hon’ble Court had quashed the orders of compulsory retirement of Govt officials. So before taking such decisions, the concerned authorities should go deep into the working of such officials and decisions should not be taken in a hurry.
Sometimes, it is out of personal differences that the adverse remarks are recorded in the service books of the aggrieved officials. The concerned officers should not take undue advantage of their position but always take subordinates into confidence and work in tandem. The Govt authorities should think twice before issuing such arbitrary decisions of compulsory retirement.
