JAMMU, Nov 2: High Court has stayed the Government order whereby a junior doctor has been posted as State Tuberculosis Officer.
The order was stayed in a petition filed by Dr Sujata Sharma, who challenged the posting of Dr Poonam on the ground that she was far junior to her but has been posted as State Tuberculosis Officer.
After hearing Advocate Sachin Gupta appearing for the petitioner, Justice Janak Raj Kotwal observed, “the post of State Tuberculosis Officer is of the rank of Deputy Director in Health Services and officers of that level are posted on this post”, adding “the petitioner and the private respondent Dr Poonam Mahajan hold equivalent post of Medical Officer and the latter is far junior to the petitioner”.
“In the seniority list of Medical Officers dated 11.05.2014, petitioner figures at serial No 126 whereas the private respondent figures at serial No 225. The petitioner’s grievance is that the private respondent has been posted as State Tuberculosis Officer over and above her as she is posted as District Tuberculosis Officer, Samba”, High Court said.
While issuing notice to the respondents, Justice Kotwal observed that subject to objections and till next date before the bench, operation of the impugned order dated 20.10.2015 shall remain stayed.
