JAMMU, Nov 1: The failure of prosecution has led to the acquittal of husband and in-laws in the dowry death case by a local court.
Those acquitted by the court are Surjeet Singh, son of Gulab Singh, Kamlesh Kour, wife of Surjeet Singh, Harbans Singh, son of Surjeet Singh and Manjeet Kour, daughter of Surjeet Singh, all the residents of village Godan Bala in Akhnoor tehsil.
According to the police case, inquest proceedings under Section 174 CrPC were initiated on a telephonic information that one Manjeet Kour, wife of Harbans Singh, who had been admitted in Military Hospital Satwari due to burn injuries sustained under suspicious circumstances, succumbed to injuries on March 9, 2009.
On March 10, 2009, a written complaint was lodged by one Kuldeep Singh, son of Lachhman Singh of Jadh alleging therein that his daughter Manjeet Kour had been married to one Harbans Singh, son of Surjeet Singh on November 12, 2003 and due to dowry demands and cruelty she had set herself ablaze on March 8, 2009 and that her in-laws without informing the parental family or the police had taken her to Army Hospital Akhnoor wherefrom she was referred to Army Hospital Satwari.
Acting on this complaint, police registered a case for the commission of offences under Sections 306/498-A RPC and after investigation of the case, the chargesheet was presented in the court of law.
After hearing both the sides, the court observed, “prosecution has neither succeeded to prove the cruelty meted out to the deceased punishable under Section 498-A RPC nor abetment to commit suicide punishable under Section 306 RPC”. Accordingly, court acquitted the alleged accused.
