JAMMU, Aug 30: In a Public Interest Litigation (PIL) filed by Bar Association, Kishtwar through its President I A Hamal seeking handing over of entire Deputy Commissioner’s office complex for use of District Courts Complex Kishtwar, Division Bench of the State High Court comprising First Puisne Judge Justice Ramalingam Sudhakar and Justice B S Walia today allowed three weeks’ time to Senior AAG Seema Shekhar to file compliance report.
When the PIL came up for hearing, Advocate Sheikh Shakeel Ahmed with Advocates Irfaan Mohammad Khan and Sheikh Najeeb Ashraf appearing for the Bar Association Kishtwar drew the attention of the Division Bench towards the detailed order passed by the Division Bench on May 27, 2016 whereby it had been directed that on shifting of Deputy Commissioner’s office to new complex, it shall be ensured that the old complex is not used for any other purpose except providing space to the judiciary and orders for transferring of the complex to judiciary shall be issued by the competent authority in consultation with the Registrar General of the High Court.
He submitted that no fresh status report in terms of order dated May 27, 2016 has been filed by the State Government particularly when the offices of Deputy Commissioner Kishtwar, Additional Deputy Commissioner Kishtwar and Assistant Commissioner (Revenue) Kishtwar have already shifted to the new Mini Secretariat, Kishtwar.
Senior AAG after taking instructions from Department of Law, Department of Revenue and Deputy Commissioner, Kishtwar submitted that 80% of the stock in the existing revenue building has been shifted to the new building and the balance 20% will be moved within a week’s time.
“Thereafter, handing over of the revenue building for the use of Judicial Department will be done, for which, formal orders will be passed by the Revenue Department in consultation with the Registrar General of the State High Court”, she added.
