Court acquits husband, in-laws of deceased

JAMMU, Sept 15: Principal Sessions Judge Udhampur, A K Koul today acquitted husband and in-laws of a woman, who had committed suicide reportedly due to harassment for want of dowry.
According to the police case, Rakesh Kumari was being harassed by her husband Ganesh Kumar, her father-in-law Babu Ram, mother-in-law Satya Devi and sister-in-law Santosh Kumari ever since her marriage with Ganesh Kumar for want of more dowry and when all attempts by Rakesh Kumari’s parents to make the accused understand the sensitivity of the relationship failed, she committed suicide by consuming poisonous substance.
During the course of investigation into the case, the offences under Sections 306/498-A/34 RPC were established against the accused persons and after completion of investigation police presented challan in the court of law.
After hearing Public Prosecutor Navneet Gupta for the State whereas Advocate Ranjeev Dubey appearing for the accused persons, Principal Sessions Judge observed, “prosecution has not been able to bring home the guilt against the accused. There are so many disturbing features in the case. The first information report and the evidence adduced at trial are at variance”, adding “the essential elements of the offences loaded against the accused have not been established as was required under law and it appears that the investigating agency has either failed to collect the best evidence or has booked the accused notwithstanding their innocence”.
With these observations, Court acquitted Ganesh Kumar, Babu Ram and Santosh Kumari of the charges leveled against them. About Satya Devi, mother-in-law of the deceased, the Court said, “the trial stands suspended by virtue of an order dated July 5, 2009 on account of her mental ailment and her inability to stand the trial”.
“The trial against her would commence from the stage she has turned unsound as and when she is fit to stand trial”, the Court said.
