Amarnath Chowdhary sent to judicial custody as court rejects his bail

JAMMU, Apr 7: The Court today rejected the bail application of Amarnath Chowdhary, main accused in committing fraud of Palm Island Mall, and sent him to judicial custody for five days.
Amarnath Chowdhary, who was absconding for the last few days since rejection of his anticipatory bail, today reached the Court of Judicial Magistrate, Ist Class, City Judge Jammu seeking surrender bail but did not get the relief. Rejecting the bail petition, Court granted his judicial custody to Crime Branch, which arrested Amarnath Chowdhary in the court premises and sent him to Kot Bhalwal Jail.
The court said that the dispute was not between two individuals but stack of more than 200 persons was involved in the matter. Their (investors) hard earned money is put at stake by the dispute between the landowner and the builder for which the clients can not be made to suffer, the court observed.
The investigation of the case is yet at its initial stage and Crime Branch is collecting the relevant evidence in the case and have not yet come to logical conclusion and in such eventuality, there is every chance of tampering with the prosecution evidence and witness of the prosecution can also be approached, which can thwart the course of investigation, the court further and refused the bail to Amarnath Chowdhary.
Pertinent to mention that this case has been in news from quite sometime. Amarnath Chowdhary allegedly entrapped a real estate company from Rajasthan showing fake land titles and claiming to be owner of the land. However, when the developer constructed the building making investment worth crores of rupees, Mr Chowdhary refused to sign the agreement to sell and execute the sale deeds in favour of the investors.
Meanwhile, the same court granted bail to Mohini Devi, wife of Amarnath Chowdhary on the ground that she was an old aged woman, has no active role in the whole process being a silent partner and also had no capacity to threaten or tamper the evidence or witnesses of the prosecution.
