HC stays transfer of Qayoom Wani

Srinagar, Feb 5: Jammu and Kashmir High Court today stayed the transfer order of Employees Joint Action Committee (EJAC) president Abdul Qayoom Wani. The administration yesterday cancelled attachments of Government School teachers including that of Wani and posted him at his native place in Tangmarg.
Justice D S Thakur in a petition filed by Employees Joint Action Committee (EJAC) president Abdul Qayoom Wani, stayed his transfer and sought reply from the respondents within two weeks. “In the meantime, operation of the impugned order to the extent of the petitioner shall not be acted upon”, court directed.
Government Advocate Mehfooz Nazki (Dy AG) appeared on behalf of Commissioner Secretary to Education Department and Director School Education, Kashmir and accepted the notice in open court.
Qayoom submits that although Government is empowered to issue transfer orders by adjusting its employees as per the procedure laid down therein but he has always been maltreated by the higher ups.
“While exercising such powers by the authorities (Director), union members of the petitioner’s union have all along been pinpointed and victimized by the Director School Education by transferring them outside their district”, reads the petition.
Petitioner challenges the Government Order bearing No. 26-Edu of 2016 dated 02.02.2016 on ground that it has been issued completely on the basis of malafides as he being President of different unions, deals with respondents and other state functionaries regarding redressal of grievances and long pending demands of his employees.
Qayoom seeks setting aside of Government Order bearing No. 26-Edu of 2016 dated 02.02.2016 so far it pertain to him on the ground that the respondents have taken a pick and choose method in the order while transferring only seven person and deployed them back to their parent departments when there are hundreds of employees working who have been deployed and attached by the officials.
