Pay Rs 17.6 lakh compensation to 2010 unrest victim: HC

SRINAGAR, Dec 16: High Court came to rescue to an artisan who had received bullet injuries by Special Protection Force of Railways in the year 2010 and directed the authorities to pay the compensation to the next kin of the victim.
Justice Hasnain Masoodi directed the authorities to pay an amount of Rs 17.60 lakh as compensation to the victim of 2010 unrest who received the bullet injuries when RSPF opened fire to disperse the mob and later succumbed to injuries.
The court directed the authorities to pay Rs 12.60 lakh as compensation to the victim and further Rs 5 lakh on account of medical treatment to the deceased in hospital and thereafter at home. The deceased was a copper smith by profession and was hailing from Samboora area of district Pulwama.
“Petitioners 2 & 3 are school going children of tender age. They have been deprived of love and affection of their father when they needed it most. Respondents 9 & 10 alive to the plight of petitioners shall deposit the awarded amount of Rs 17,60,000 with Registry within four weeks, where after the amount awarded shall carry interest at 9% per annum till it is so deposited”, said Justice Masoodi.
Court while granting the compensation said that even if the income of deceased as claimed by the petitioners (wife and children of the deceased) was Rs 20, 000 is taken to be exaggerated or is projected at higher side, yet in the facts and circumstances of the case Rs 10500 would reasonable be taken as the monthly income of the deceased at the time of his death.
“He had a family comprising of four persons including him to mend for. The deceased, is to be taken to have been spending 1/3rd of his income  on his personal expenses. His net income therefore, was Rs. 7000 per month and annual income Rs 84000. Having regard to his age at the time of his death, the victim would have contributed Rs 7000 per month to his family kitty for at least next 15 years,” the court said and thus granted the compensation to the tune of Rs 17.60 lakhs.
