JAMMU, Dec 9: City Judge Jammu, M S Manhas today stayed the order whereby Dewan Chand Bansal’s membership of Amar Singh Club was suspended.
The Secretary of the Club, Vijay Saraf vide order dated November 27, 2015 suspended the membership of Dewan Chand Bansal on certain grounds. However, this order was challenged in the court of City Judge Jammu.
It was submitted before the court by the counsel of Dewan Chand Bansal that Secretary of the Amar Singh Club was pressuring him for forcing the members, who had filed a suit against the present Executive Committee for resorting to the mis-management in the club, to withdraw the same. The Secretary of the Club even threatened Dewan Chand Bansal of expulsion from the club in case the suit was not withdrawn.
“As the plaintiff refused to follow the instructions of Secretary of the Club, the latter in utmost arrogance to the court’s intervention and as a sheer act of retaliation suspended the plaintiff by issuing an order dated November 27, 2015”, the counsel for Dewan Chand Bansal said.
After hearing both the sides, City Judge Jammu observed, “the applicant has qualified all the three golden principles for grant of interim relief in his favour”. Accordingly, the court stayed the operation of the impugned order passed by Secretary of the Amar Singh Club on November 27, 2015 till the disposal of the main suit.
