SRINAGAR, Dec 8: Jammu and Kashmir High Court today directed the beneficiaries of the fake certificate scam in Indian Medicine System Department (ISM) to file response before taking decision on removal of ISM Director.
The Division Bench comprising Justice MH Attar and Justice JR Kotwal before passing any order on removal of Director ISM, Dr Abdul Kabir Dar, directed the respondents to file their response to the inquiry report and posted the matter in February 2016 for further consideration.
Court passed this order after the one man commission filed its report into the scam. The court sought response of the candidates who have been issued certificates by the ISM and are party in the PIL.
During the arguments senior advocate, Bashir Ahmad Bashir submitted before the court that till such time the Director of the ISM who is allegedly involved in the scam be directed not to function on the post of Director.
However, DB said: “Let response be filed to the inquiry report by the respondents and Registry is directed to furnish the copy of inquiry report to the counsels representing the private candidates.”
Earlier, three member inquiry committee was constituted by the Government about the issuance of Dawasaaz (Pharmacist) certificates by the Director ISM Dr. Abdul Kabir to the hundreds of persons which later on has been withdrawn and one man inquiry committee Special Secretary of H&ME department was directed to be appointed. However, court had directed for keeping the report of earlier committee (three member committee) intact.
It is alleged that Director ISM has issued Dawasaaz (Pharmacist) certificates to the hundreds of persons as none of them have ever been admitted in any college or institute for undergoing such training or ever having attended any classes or practicals or appearing in any test or examination.
Petitioner is seeking cancellation of Dawasaaz certificates issued by the Director Kabir and direction for registration of FIR against the Director ISM under Section 5(2) of the PC Act and till such time he(Director) be removed from the post so that the record be protected.
